About the summaries

Each section includes a brief Plain (User-Friendly Version) to help you understand the terms. These summaries are for convenience only and do not replace or modify the Formal (Legal Version) that follows. If there’s any difference, the Formal (Legal Version) controls.

Acceptance. By accessing or using the ForuSage Platform as a Creator, you agree to be bound by these Creator Terms and the ForuSage Terms of Service (“Main Terms”). If you do not agree, you may not publish or sell Guides on the Platform.

Platform Description. ForuSage is a digital marketplace where independent travel creators publish and sell original itineraries and guides to travelers through the ForuSage website and app.

These Creator Terms are a legally binding agreement between you (“Creator,” or “Seller”) and ForuSage LLC (“ForuSage,” “we,” “our,” “us”). They apply in addition to the ForuSage Terms of Service, which govern overall use of the Platform.

Section 0: Definitions

Formal (Legal Version)

Unless otherwise defined herein, capitalized terms have the same meaning as in the ForuSage Terms of Service (“Main Terms”). For clarity:

  • Creator means a user who creates, uploads, publishes, or sells digital travel guides, itineraries, or related content on the Platform.
  • Founding Creator means one of the first seventy-five (75) qualified Creators meeting ForuSage’s Founding Program criteria as described in Section 5.
  • Subscription Plan means a recurring, paid plan that enables a Creator to publish, maintain, and receive payouts for Guides on the Platform.
  • Commission means the percentage of each Guide sale retained by ForuSage prior to Creator payout.
  • Net Payout means the amount payable to a Creator after deduction of Platform Commissions, refunds/chargebacks, or adjustments.
  • Stripe Connect Account means the payment account registered by a Creator through Stripe, Inc. for the purpose of receiving payouts from ForuSage.

Plain (User-Friendly Version)

  • Creator: You — the person or team publishing and selling guides.
  • Founding Creator: One of the first 75 approved creators who qualify for special rates.
  • Subscription Plan: The monthly plan that lets you publish and get paid.
  • Commission: ForuSage’s share of each sale.
  • Net Payout: What you earn after commissions and any dispute adjustments.
  • Stripe Connect Account: Your Stripe profile used for identity checks and payouts.

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 1: Relationship to the Main Terms of Service

Formal (Legal Version)

  • These Creator Terms supplement and incorporate the ForuSage Terms of Service. In the event of any conflict, these Creator Terms control for Creator activities. By enrolling as a Creator, you agree that:
  1. You remain an independent contractor and not an employee, agent, or partner of ForuSage.
  2. You are fully responsible for your business activities, taxes, and compliance with applicable laws.
  3. You will maintain your Subscription Plan and Stripe Connect account in good standing.
  4. These Creator Terms, the Main Terms, and the Privacy Policy collectively form your complete agreement with ForuSage.

Plain (User-Friendly Version)

These rules are just for creators and sit alongside the main Terms. You’re an independent creator, not our employee. You handle your taxes, follow your local laws, and keep Stripe + your subscription active. Together, these Terms plus the Privacy Policy are the full agreement.

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 2: Eligibility & Stripe Connect

Formal (Legal Version)

  1. Age and Legal Capacity. You must be at least eighteen (18) years old and legally capable of entering into binding agreements.
  2. Residency and Supported Regions. You must reside in a country supported by Stripe Connect for Creator payouts. ForuSage does not support Creators based in jurisdictions restricted under U.S. sanctions or where Stripe Connect is unavailable.
  3. Verification. Stripe Connect performs required identity, tax, and banking verification. ForuSage does not separately collect sensitive financial or personal identification data beyond linkage needs.
  4. Account Status. Creators must maintain an active Stripe Connect account to receive payouts. Suspension, closure, or verification failure may delay or prevent payment. Use of Stripe Connect is subject to the Stripe Connected Account Agreement (https://stripe.com/legal/connect-account).
  5. Creator Teams. A Creator may authorize team members to contribute to content creation or account management. The primary account holder remains legally responsible for all actions under the account.
  6. Export Controls & Sanctions Compliance. Creator represents and warrants that Creator: (i) is not located in, organized under the laws of, or ordinarily resident in any jurisdiction subject to comprehensive U.S. sanctions or embargoes (including, without limitation, Cuba, Iran, North Korea, Syria, or the Crimea, Donetsk, or Luhansk regions of Ukraine); (ii) is not a person or entity identified on any U.S., U.K., E.U., or U.N. sanctions or restricted parties list, including but not limited to the U.S. Department of the Treasury’s Specially Designated Nationals and Blocked Persons List, the U.S. Department of Commerce Entity List, or HM Treasury’s Consolidated List; and (iii) will not export, re-export, transfer, or otherwise make available the Platform or proceeds of sales for the benefit of any sanctioned person or in violation of applicable export control and sanctions laws (including the U.S. Export Administration Regulations and applicable economic sanctions programs). ForuSage may suspend or terminate access and withhold payouts where it reasonably believes a breach of this subsection has occurred.
  7. Insurance. Creator is solely responsible for maintaining any business, liability, or other insurance appropriate to Creator’s activities and content. ForuSage does not provide insurance to Creators.
  8. Accuracy of Information. Creator represents that all account, identity, tax, and payment information supplied to ForuSage or Stripe is true, accurate, and complete, and agrees to promptly update such information as changes occur.

Plain (User-Friendly Version)

To sell on ForuSage you must be 18+, live where Stripe Connect works, complete Stripe’s checks, and keep your Stripe account active. You can have teammates, but you’re responsible for the account. You can’t use ForuSage if you’re in a fully sanctioned country/region or on a government sanctions list. If we suspect a sanctions/export issue, we may pause your account and payouts. We don’t provide creator insurance. Keep your account, tax, and payout info accurate and up to date.

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 3: Creator Subscription Plans

Formal (Legal Version)

  1. Subscription Requirement. An active Subscription Plan is required to publish new Guides, update listings, and receive payouts.
  2. Subscription Tiers.
    • Standard Creator Tier: $8.99 USD/month, with a ninety (90) day free trial.
  3. Billing & Renewal. Fees bill monthly via Stripe to the payment method on file and auto-renew unless canceled before the next cycle.
  4. Non-Payment. If a Creator’s subscription payment fails or lapses, ForuSage will pause the Creator’s ability to publish new content, edit existing content, or accept new purchases until payment is restored. Such a lapse does not affect the Creator’s entitlement to receive payouts for completed purchases made prior to the lapse.
  5. Payout Access. Regardless of subscription status, Creators will retain access to their connected Stripe account through the Platform for purposes of receiving payouts, managing bank information, and accessing tax documentation, subject to Stripe’s terms and controls.
  6. Suspension & Reinstatement. If a Creator’s subscription is cancelled or suspended, the Creator’s Guides will be removed from sale and unavailable for new purchases until the subscription is reinstated. Such suspension does not affect access rights of Buyers who previously purchased the Guides, and those Buyers may continue to view their purchased content in accordance with these Terms. Upon reinstatement of the subscription, the Creator may resume publishing, updating, and offering Guides for sale, subject to Platform requirements.
  7. Refunds. Subscription fees are non-refundable, except where required by law.
  8. Cancellation; No Proration or Refund. A Creator may cancel their subscription at any time through the Platform. Cancellation will take effect at the end of the current billing period, and the Creator will continue to have access to subscription features until that time. No refunds. Subscription fees are non-refundable, and ForuSage does not provide prorated refunds or credits for partial billing periods, except as required by applicable law.

Plain (User-Friendly Version)

A $8.99 USD/month Standard Creator subscription (90-day free trial) is required to publish or update Guides and accept new purchases; subscriptions auto-renew monthly via Stripe and are non-refundable (except as required by law), cancellation takes effect at the end of the billing period, Guides are removed from sale if a subscription lapses (but prior buyers retain access), and Creators always retain access to Stripe for payouts and tax records, including for sales complete before any lapse.

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 4: Platform Commission & Payouts

Formal (Legal Version)

  1. Pricing Freedom. Creators set their own prices, subject to a platform minimum of $9.99 USD per Guide.
  2. Commission Structure.
    • Founding Creators: 20% platform commission on gross sales.
    • Standard Creators: 25% platform commission on gross sales.
    • High-Volume Creators: ≥ $500 USD gross sales in a calendar month → 22% platform commission for that month.
  3. Net Payout Calculation. Net Payout = Sale Price – Platform Commission – Refunds/Chargebacks – Adjustments.
  4. Merchant of Record & Payout Flow. ForuSage LLC is the Merchant and Seller of Record for all transactions on the Platform. Buyers purchase from ForuSage, which processes payments and issues payouts to Creators via Stripe Connect. ForuSage holds sale proceeds for seven (7) days after each transaction before disbursing Creator payouts to allow time to identify and begin reviewing potential disputes, chargebacks, or fraud inquiries. If an issue is reported or remains under review, payout may be temporarily delayed until the matter is resolved. This process helps reduce operational risk and costs for both ForuSage and participating Creators.
  5. Stripe Fees. ForuSage covers all Stripe transaction and processing fees; Creators receive their net payout amounts as reflected in their Stripe Connect dashboard. Platform commissions, applicable fees, and any required taxes or withholdings (if applicable) are itemized in the Creator’s payment records available through the Platform.
  6. Adjustments. ForuSage may deduct or offset from future payouts any chargebacks, refunds, or erroneous payments.
  7. Reserves & Risk Holds. ForuSage or Stripe may place a reserve, delay payouts, or net negative balances against future payouts based on fraud, dispute, or chargeback risk assessments, or to comply with lawful orders or compliance reviews.

Plain (User-Friendly Version)

You pick your price (min $9.99 USD). Fees: Founding 20%, Standard 25%, or 22% if you sell $500+ in a month. Buyers buy from ForuSage; you’re paid via Stripe Connect after a 7-day hold. We cover Stripe fees. If there’s a chargeback or refund, it can be taken from future payouts. We or Stripe may hold funds for risk or compliance reasons.

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 5: Founding Creator Program

Formal (Legal Version)

  1. Eligibility. The first seventy-five (75) verified Creators who publish at least three (3) complete, compliant Guides within ninety (90) calendar days of gaining publishing privileges qualify as “Founding Creators.”
  2. Benefits. Founding Creators receive: (i) 20% platform commission in perpetuity for as long they maintain and comply with the Founding Creator terms as set forth herein; (ii) Founding recognition.
  3. Reversion for Non-Publication. If a Founding Creator fails to publish three (3) eligible Guides within the initial ninety (90) days, ForuSage may automatically reclassify the account as a Standard Creator and revoke Founding benefits. ForuSage may reassign the Founding Creator slot to another eligible Creator at its discretion.
  4. Non-Transferability. Founding status cannot be sold, transferred, or assigned.
  5. Revocation. Repeated violations, non-payment, or inactivity ≥ six (6) consecutive months may result in revocation.
  6. Modification. ForuSage may amend or discontinue the program with notice; existing compliant Founding Creators retain benefits unless revoked.

Plain (User-Friendly Version)

To keep Founding status, publish 3 full guides in your first 90 days. If you don’t, your account can switch to Standard and lose Founding perks, and we may give that Founding slot to someone else. It’s not transferable. We can revoke for rule breaks or long inactivity.

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 6: Content Standards & Upload Guidelines

Formal (Legal Version)

  1. File Formats and Limits. Only JPEG or PNG images, each ≤ ten megabytes (10 MB). No video uploads.
  2. Written Content. Text must be original and composed within the ForuSage rich-text editor. No embedded scripts, external code, or non-approved HTML.
  3. External Links. Only ForuSage-approved external links (e.g., official attraction/venue sites). Affiliate, referral, or advertising links are prohibited.
  4. Guide Length. A Guide may cover no more than fourteen (14) consecutive days.
  5. Copyright and Ownership. Creators must own or hold commercial rights to all text, photos, and media. Uploading third-party or AI-generated content that replicates copyrighted works without rights/licenses is a material breach.
  6. Optimization. ForuSage may resize, compress, or reformat content to improve performance and usability without altering substance.
  7. Responsibility. Creators are solely responsible for factual accuracy, originality, and compliance with copyright, trademark, and defamation laws.
  8. Creator Representations & Warranties. Creator represents and warrants that all content is: (i) original to Creator or properly licensed, (ii) accurate and not misleading or defamatory, (iii) compliant with all applicable laws and third-party rights, and (iv) free of undisclosed sponsored, paid-placement, or affiliate promotion.
  9. AI Disclosure. If any text or imagery is AI-generated or materially AI-edited, Creator must clearly and conspicuously disclose that fact within the Guide.
  10. Releases. Where content depicts identifiable persons or privately owned property, Creator represents and warrants that Creator has obtained valid, written model or property releases permitting commercial use of such content, and will furnish copies to ForuSage upon request.
  11. Confidentiality. Creator shall not disclose or use ForuSage’s non-public information (including internal tools, policies, dashboards, metrics, and communications) except as necessary to use the Platform. Upon request, the Creator shall promptly delete or return such information.

Plain (User-Friendly Version)

Images: JPEG/PNG under 10 MB, no video. Write in our editor (no outside code). Only link to official sites — no affiliate links. Max guide length: 14 days. You must own or have rights to everything. You promise your content is accurate, legal, and not secretly sponsored. If you used AI, say so clearly. We may optimize files so things load fast. If your photos show people or private property, you must have written permission. Don’t share our internal tools or docs.

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 7: Content Ownership & License Grant

Formal (Legal Version)

  1. Creator Ownership. Creators retain ownership of original content, subject to these Terms.
  2. License to ForuSage. By uploading/publishing content, Creator grants ForuSage a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to: (1) host, display, reproduce, and distribute on the Platform; (2) use excerpts/thumbnails/previews for marketing/editorial; (3) cache/store copies for backup/continuity; and (4) retain archived versions for audit/legal/compliance.
  3. Public Display. Creator consents to public display of name, profile, and thumbnails in ForuSage marketing unless withdrawn in writing.
  4. AI/Derivative Training. ForuSage will not use Creator content to train external AI models or derivative tools.
  5. License Survival. The above license survives account termination to maintain access for prior Buyers.
  6. Brand Use. Except as expressly allowed by these Terms or a written brand-use permission, Creator may not use ForuSage’s names, trademarks, logos, or trade dress in a manner that suggests endorsement or partnership.

Plain (User-Friendly Version)

You own your work. You let us host/show it, use previews to promote, and keep backups/archives. We won’t train outside AI models on your content unless you opt in. Buyers who already paid keep access. Don’t use our name or logo like we officially endorse you unless we say it’s okay.

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 8: Prohibited Content & Platform Moderation

Formal (Legal Version)

  1. Prohibited Content. Content may not: (1) infringe IP rights; (2) be false, misleading, or defamatory; (3) promote unsafe/illegal activity; (4) include explicit, obscene, or discriminatory material; (5) misuse/misrepresent AI-generated content as human-created; (6) include hidden/embedded advertising or affiliate schemes; (7) solicit or steer Buyers to off-platform transactions intended to avoid Platform fees or controls (see Section 9(f)).
  2. Community Flagging. Any user may flag suspected violations; flagged content may be temporarily hidden during review.
  3. Moderation Process. ForuSage will notify the Creator and allow up to ten (10) business days for response or proof of rights. Absent satisfactory evidence, content may be permanently removed.
  4. Repeated Violations. Repeated or egregious violations may lead to suspension, forfeiture of pending payouts, loss of Founding status, or termination.
  5. Appeals. One appeal permitted within ten (10) business days to support@forusage.com (Attention: Appeals). ForuSage’s appeal decision is final.
  6. DMCA Notice-and-Takedown; Repeat Infringers. Allegations of copyright infringement shall be handled in accordance with the notice-and-takedown procedure described in the ForuSage Main Terms of Service, Section 6(e) (DMCA Safe Harbor / Copyright Complaints).
  7. Documentation Requests; Audit Right. ForuSage may request reasonable documentation (including proof of rights, licenses, releases, or factual substantiation) and audit Creator compliance with these Terms on a limited basis. Failure to timely provide documentation is a material breach and may result in content removal, suspension, or termination.

Plain (User-Friendly Version)

Don’t post what you don’t own, anything unsafe/offensive, or undisclosed ads/affiliate links. Don’t pretend AI work is human-made. Don’t steer buyers off-platform to dodge fees. Flags trigger a review; you’ll have ~10 business days to respond. Repeated issues can lead to suspension. You can appeal once. Copyright complaints follow the DMCA steps in the Main Terms.

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 9: Pricing & Minimum Guide Value

Formal (Legal Version)

  1. Minimum Price. Each Guide must be priced at no less than $9.99 USD.
  2. Currency Display. Prices display in USD; Stripe may convert payouts to Creator’s local currency.
  3. Dynamic Pricing. Creators may change prices at any time, provided changes are not used to manipulate ranking or circumvent fees.
  4. Discounts & Promotions. With Creator consent, ForuSage may offer limited-time discounts or promotions on a Creator’s Guides. Unless otherwise expressly agreed in writing, any discount applies to the sale price, and Creator payouts are calculated based on the discounted price using the same revenue share percentage. ForuSage will not reduce a Creator’s revenue share percentage or apply additional deductions without the Creator’s consent.
  5. Taxes. Except where ForuSage collects/remits taxes as required by law, Creators are responsible for including and handling applicable VAT/GST/sales tax consistent with Section 11.
  6. Non-Circumvention. Creator shall not solicit, direct, or process substantially similar guide sales, updates, or custom itinerary work off-platform with existing or prospective ForuSage Buyers in order to avoid Platform fees. Violations may result in fee recapture, suspension, or termination.

Plain (User-Friendly Version)

Min price is $9.99 USD. Prices show in USD; Stripe converts payouts. You can change prices anytime. We won’t run promos that reduce your take-home without asking. Handle your taxes unless we’re required to collect/remit. Don’t move sales off-platform to dodge fees.

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 10: Refunds, Chargebacks & Buyer Disputes

Formal (Legal Version)

  1. All Sales Final. Guides are digital and accessible immediately; all sales are final except where required by law.
  2. Refund Authorization. ForuSage may, in its sole discretion, authorize refunds for: (1) verified fraudulent transactions; (2) material misrepresentation or broken elements rendering the Guide unusable; or (3) technical failure preventing access despite good-faith support.
  3. Creator Cooperation. Creator will cooperate in good faith with refund/chargeback investigations and provide documentation within seven (7) business days of request.
  4. Chargeback Deductions. As Merchant of Record, ForuSage handles all refunds and chargebacks. Related amounts and fees may be recovered from future Creator payouts.
  5. Buyer Disputes. ForuSage may mediate Buyer–Creator disputes; decisions are final and binding.
  6. EU/UK Withdrawal Waiver. For EU/UK Buyers, statutory withdrawal rights are waived once digital access begins.
  7. EU/UK Waiver UX Capture. ForuSage will present at checkout a clear affirmative checkbox where EU/UK Buyers (i) request immediate access and (ii) confirm they waive the 14-day withdrawal right. Creators acknowledge and authorize ForuSage to collect and rely on such consents (with timestamp) for their sales.

Plain (User-Friendly Version)

Sales are final. Refunds only for fraud, serious guide problems, or tech failures. You must respond within 7 business days if we ask for info. As MoR, ForuSage handles refunds/chargebacks and may deduct related costs from future payouts. EU/UK buyers waive the 14-day right at checkout.

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 11: Taxes & Financial Reporting

Formal (Legal Version)

  1. Creator Responsibility. Although ForuSage is the Merchant and Seller of Record for Buyer transactions, Creators are solely responsible for income and business taxes arising from payouts they receive (e.g., income tax, self-employment, corporate).
  2. Indirect Taxes. Where applicable law requires ForuSage to collect and/or remit sales/use/VAT/GST as MoR, ForuSage may do so. Where such obligations do not fall on ForuSage, Creator remains responsible for determining, collecting, and remitting any indirect taxes on their earnings in relevant jurisdictions.
  3. Stripe Facilitation. Stripe Connect may calculate/withhold/report certain taxes where required by law. ForuSage does not act as a tax agent and assumes no liability for compliance beyond obligations expressly placed on it by law.
  4. Information Reporting. ForuSage and/or Stripe may issue IRS Form 1099-K, EU DAC7, or similar reports to tax authorities as required.
  5. International Obligations. Non-U.S. Creators are responsible for local registrations and filings.
  6. Indemnification. Creators will indemnify ForuSage for penalties or costs arising from their tax non-compliance.

Plain (User-Friendly Version)

ForuSage is the MoR for buyer payments, but you are responsible for your income taxes on payouts. If laws require us to collect/remit sales/VAT/GST, we may do that; otherwise you handle it. Stripe may help with some reporting, but you must stay compliant where you live.

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 12: Performance, Data & Metrics

Formal (Legal Version)

  1. ForuSage may collect aggregated sales/engagement data to provide Creator analytics and to improve the Platform.
  2. Data may include page views, conversions, and anonymized demographics; personal buyer data is not disclosed to Creators.
  3. ForuSage owns aggregated/anonymized analytics.
  4. Creators may use their performance data so long as no personally identifiable buyer info is disclosed.

Plain (User-Friendly Version)

You get dashboards with views and sales. We keep buyer details private. Use your stats freely — just don’t share anyone’s personal info.

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 13: Platform Optimization & Storage

Formal (Legal Version)

  1. Optimization. ForuSage may compress, resize, or cache content for speed/stability without altering meaning.
  2. Backups & Retention. Routine backups occur, but permanent availability of any specific file is not guaranteed.
  3. Creator Backups. Keep local copies; ForuSage isn’t liable for data loss from deletion/failure/outage.
  4. Storage Limits. Reasonable storage or bandwidth limits may be imposed to protect performance.
  5. Force Majeure (Cross-Reference). The parties’ obligations are subject to the Force Majeure provision in the Main Terms (Section 11). Creator obligations (including compliance, cooperation in investigations, and indemnification) continue notwithstanding such events.

Plain (User-Friendly Version)

We optimize files so guides load fast. Keep your own backups. We may set fair storage limits to keep the platform speedy. Sometimes outages happen — our Force Majeure rule in the Main Terms applies.

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 14: Pausing or Removing Guides

Formal (Legal Version)

  1. Creator Archiving. Creators may archive a Guide at any time through the Platform. An archived Guide is removed from sale and unavailable for new purchases, but does not affect access rights of Buyers who previously purchased the Guide, who may continue to view their purchased content in accordance with these Terms.
  2. Reactivation. An archived guide may be restored to active status by the Creator, subject to Platform requirements and an active subscription.
  3. Platform Removal. ForuSage may remove/unlist Guides that violate these Terms, contain inaccurate or unsafe content, or receive repeated flags.
  4. Buyer Access. Removal, unlisting, archiving, or Creator account changes do not revoke access to Guides already purchased by Buyers, except where continued access is not technically feasible or is required to be restricted by law.
  5. Content Updates. Creators may issue updated versions; each upload is subject to review/optimization.
  6. Archival Rights. ForuSage may retain archived copies of Guides and related materials as reasonably necessary to provide ongoing access to Buyers who previously purchased such Guides, and for audit, security, operational continuity, compliance, or legal purposes.

Plain (User-Friendly Version)

Creators can archive Guides to stop new sales and later reactivate them with an active subscription; ForuSage may unlist Guides for policy or safety reasons, but Buyers keep access to Guides they’ve already purchased (unless access is legally or technically impossible).

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 15: Account Suspension & Termination

Formal (Legal Version)

  1. Grounds. Fraud, IP infringement, non-payment, terms breach, or inactivity (≥ six months) may result in suspension/termination.
  2. Notice. Where feasible, ForuSage will notify by email and may offer a cure period.
  3. Effect of Suspension. No publishing or payouts until issues are resolved.
  4. Effect of Termination. Platform access ceases; previously sold Guides may remain available to Buyers per Section 14(c).
  5. Outstanding Balances. Earned but unpaid amounts may be withheld pending investigations or chargeback/refund deductions.
  6. Appeal. One appeal within ten (10) business days to support@forusage.com (Attention: Appeals); decision is final.

Plain (User-Friendly Version)

We can pause/close accounts for fraud, IP issues, unpaid fees, rule breaks, or long inactivity. We’ll try to warn you. Suspended accounts can’t publish or get paid. After termination, buyers may access prior purchases for up to 12 months. You can appeal once.

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 16: Indemnification & Limitation of Liability

Formal (Legal Version)

  1. Indemnification. Creator will indemnify ForuSage and its affiliates, officers, directors, employees, and agents for claims/costs arising from: Creator content; breach of these Creator Terms/Main Terms; violations of law or third-party rights; tax non-compliance; or disputes with Buyers/third parties.
  2. Limitation of Liability. To the fullest extent permitted by law: (1) ForuSage is not liable for indirect/special/consequential/punitive damages; (2) ForuSage’s total aggregate liability to any Creator shall not exceed the greater of $100 USD or the platform fees paid by that Creator in the prior twelve (12) months; (3) applies to all legal theories.

Plain (User-Friendly Version)

If your actions create legal costs for us, you’ll cover them. We’re not liable for indirect losses. Our max liability is $100 or what you paid us in platform fees over the last year.

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 17: Governing Law & Dispute Resolution

Formal (Legal Version)

  1. Governing Law. These Creator Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law principles.
  2. Arbitration (AAA Consumer Arbitration Rules). Any dispute, controversy, or claim arising out of or relating to these Creator Terms, the Platform, or any transaction conducted through it shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
  3. Venue/Language/Arbitrator. Arbitration shall occur in Oakland County, Michigan, in English, before a single arbitrator.
  4. Small Claims. Either party may bring an individual action in small claims court for eligible disputes.
  5. Class/Collective Waiver. All claims must be brought on an individual basis; class actions, representative suits, or private attorney general claims are not permitted.
  6. Opt-Out. You may opt out of arbitration by sending written notice to support@forusage.com within thirty (30) days of first accepting these Terms.
  7. Attorneys’ Fees. The prevailing party in any arbitration or related judicial proceeding shall be entitled to recover reasonable attorneys’ fees and costs.
  8. Equitable Relief. Notwithstanding arbitration, either party may seek temporary or permanent injunctive or other equitable relief in any court of competent jurisdiction to prevent or stop (i) infringement, misappropriation, or violation of intellectual property or proprietary rights, (ii) breach of confidentiality, or (iii) circumvention or interference with the Platform.
  9. Federal Arbitration Act. The Federal Arbitration Act (9 U.S.C. §1 et seq.) governs interpretation and enforcement of this Section, including questions of arbitrability. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement.

Plain (User-Friendly Version)

Disputes use Michigan law and AAA Consumer Rules arbitration in Oakland County. Small claims are allowed for small issues. No class actions. You can opt out of arbitration within 30 days. For urgent issues like IP misuse or trying to bypass the platform, either side can go to court for an injunction. U.S. federal arbitration law applies.

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 18: Modifications & Notices

Formal (Legal Version)

  1. Modifications. ForuSage may modify these Creator Terms, the Main Terms, or platform fees with at least 30 days’ notice via the Platform or email; continued use after the effective date is acceptance.
  2. Notices. Official communications may be sent to the registered account email; Creators must keep it accurate and active.
  3. Contacts. General: support@forusage.com | Legal: support@forusage.com (Attention: Legal) | Finance/Tax: support@forusage.com (Attention: Finance) | Appeals: support@forusage.com (Attention: Appeals).
  4. Language and Translations. These Creator Terms are drafted in English and the English version controls. Any translations or localized versions are provided solely for convenience and do not modify the English version.

Plain (User-Friendly Version)

We’ll give you at least 30 days’ notice for changes. Keep your email current. For help, reach out to support or legal. The English version is the binding one.

This summary is provided for convenience only; the Formal (Legal Version) above controls.

Section 19: Entire Agreement & Survival

Formal (Legal Version)

  1. Entire Agreement. These Creator Terms + Main Terms + Privacy Policy form the entire agreement and supersede prior agreements.
  2. Severability. If a provision is invalid, the rest remains effective.
  3. Non-Assignment. Creators may not assign rights or accounts without ForuSage’s written consent; ForuSage may assign in connection with a merger, acquisition, or asset sale.
  4. Survival. Sections 2(f)–(h), 3(f)–(g), 4(c)–(g), 5(c)–(f), 6(h)–(k), 7(b)–(e), 8(c)–(g), 9(f), 10(d)–(g), 11, 12, 13, 14(e), 15(e), 16–18, and any provisions which by their nature should survive, remain in effect after termination or expiration.
