ForuSage Terms of Service

Welcome to ForuSage, a curated marketplace for digital travel itineraries and experiences. These Terms & Conditions (“Terms”) form a legally binding agreement between you (“User”, “Buyer”, or “Seller”) and ForuSage LLC (“ForuSage”, “we”, “our”, “us”). By accessing or using the ForuSage website, mobile app, or services (collectively, the “Platform”), you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Platform.

1. Platform Overview

ForuSage is a digital marketplace enabling creators (“Sellers” or “Guides”) to publish, price, and sell travel-related digital content—such as itineraries, guides, and curated recommendations—to travelers (“Buyers”). Content is accessed exclusively within the ForuSage application and may not be downloaded or redistributed.

ForuSage does not offer booking services and is not responsible for third-party experiences suggested by guides.

2. Eligibility

You must be 18 years or older and capable of entering into a binding agreement to use the ForuSage Platform as either a Buyer or Seller.

To receive payouts as a Seller, you must:

  • Establish a valid, verified Stripe account (our third-party payment processor);
  • Complete Stripe’s identity and eligibility verification process (including proof of age and identity);
  • Comply with Stripe’s terms and conditions, including those governing your country or region.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3. Seller Responsibilities

As a Seller, you agree to:

  • Provide original content or content you are licensed to use commercially.
  • Avoid using AI-generated content that replicates copyrighted materials unless you have explicit rights.
  • Ensure your listing is accurate, complete, and valuable.
  • Set your own pricing above any platform minimum.
  • Comply with applicable tax, business, and legal obligations.
  • Establish and maintain a verified Stripe account, including submitting your legal name, age, and required personal details for identity verification and payout eligibility.

We reserve the right to audit, suspend, or remove content or accounts at any time.

4. Buyer License and Use of Content

Buyers receive a non-transferable, non-exclusive license to view purchased guides within the ForuSage application. Buyers may not:

  • Download, copy, or redistribute content
  • Use content for commercial purposes
  • Circumvent access controls

5. Content Ownership & Licensing

Sellers retain ownership of their content but grant ForuSage a worldwide, royalty-free, sublicensable, irrevocable license to host, display, promote, and distribute content on the platform and in marketing.

6. Payments, Fees, and Payouts

  • Sellers choose their own prices, subject to a platform-wide minimum guide price of $5.00 USD.
  • ForuSage retains a platform commission of 25% on the sale price of each guide.
  • The remaining 75% is payable to the Seller via our third-party payment provider (e.g., Stripe), minus any applicable transaction processing fees.
  • Payouts will only be issued to Sellers with a valid, verified Stripe account.
  • Sellers are responsible for maintaining accurate and complete payout information with Stripe.
  • Buyers gain access to guide content immediately after payment is processed.
  • Platform fees and minimums are subject to change with 30 days’ notice, which will be posted to the Seller Dashboard or delivered via email.

7. Taxes & Financial Responsibility

Sellers are responsible for all income, sales, or VAT taxes. ForuSage does not remit taxes unless required by law. Sellers must comply with all relevant financial obligations and laws in their jurisdictions.

8. No Refund Policy

All sales are final due to the nature of digital goods. However, refunds may be issued at our discretion in cases of:

  • Fraudulent transactions
  • Misleading or broken content
  • Violation of these Terms

Buyers must submit refund requests within 7 days of purchase.

9. Acceptable Use Policy

You may not:

  • Upload or sell infringing, stolen, or misleading content
  • Post hateful, obscene, or dangerous materials
  • Promote illegal activity or unsafe travel behavior
  • Scrape or automate data access
  • Interfere with other users or platform systems

10. Intellectual Property Indemnification

You agree to indemnify and hold ForuSage harmless from any legal claims arising from content you upload, including infringement, misrepresentation, or misuse of third-party rights.

11. Limitation of Liability

To the fullest extent permitted by law:

  • ForuSage is not liable for any inaccuracies, travel mishaps, or loss resulting from use of the platform or content.
  • Our maximum liability to any user is the greater of $100 or the amount paid to ForuSage in the prior 12 months.

12. Disclaimer of Warranties

The platform is provided “as is” and “as available”, with no guarantees of accuracy, security, or uptime. Use is at your own risk.

13. User Feedback & Reviews

Buyers may leave reviews. ForuSage may remove or moderate reviews that are:

  • Abusive or misleading
  • In violation of any policies

Sellers may not manipulate review systems.

14. DMCA & Copyright Complaints

If you believe content infringes your copyright, submit a takedown request to:

15. Arbitration and Dispute Resolution

By using the platform, you agree to resolve disputes via binding arbitration and waive rights to class actions or jury trials. Jurisdiction: State of Michigan.

16. Force Majeure

We are not liable for failure to perform due to events outside our control, including natural disasters, war, cyberattacks, government actions, or technical outages.

17. Data Usage and Security

We collect and process data per our Privacy Policy. While we use reasonable measures to secure data, no system is completely secure.

18. Third-Party Tools & Integrations

The platform uses services like Stripe, mapping APIs, and analytics tools. Use of those services is governed by their own terms and policies.

19. Change of Control

If ForuSage is acquired or merged, your account and data may be transferred. You will be notified of any material change.

20. Termination

We may suspend or terminate your account for any reason including policy violations. You may also deactivate your account by contacting us.

21. Modifications to These Terms

We may modify these Terms at any time. Notice will be posted on the platform. Continued use indicates acceptance of the updated Terms.

22. Additional Clauses

Platform Suspension & Appeal Process

We may suspend any account pending investigation. Users may request a review, but reinstatement is not guaranteed.

Right to Audit Seller Content

We reserve the right to request proof of content ownership. Failure to comply may result in removal and legal action.

Deactivation & Content Survival

If a Seller account is terminated, previously purchased content may remain accessible to Buyers for a limited time.

COPPA Compliance

The platform is not intended for users under 13. We do not knowingly collect personal data from children.

Accessibility Commitment

We strive to ensure accessibility for all users. Contact support if you encounter access issues or need accommodations.

Survivability Clause

Sections 5, 10, 11, 12, 15, and 21 shall survive termination of this agreement.

Beta Features Disclaimer

Beta or experimental features are offered “as is” and may change without notice.

23. Data Rights Under GDPR and CCPA

If you are a resident of the European Economic Area (EEA) or California, you have the following rights:

a. Right to Access

Request a copy of the personal data ForuSage holds about you.

b. Right to Correction

Request correction of inaccurate or incomplete data.

c. Right to Deletion

Request deletion of your personal data, subject to legal exceptions.

d. Right to Data Portability

Request a copy of your data in a portable format.

e. Right to Object or Restrict Processing

Object to or limit how we process your data in certain cases.

f. Right to Opt Out of Sale (CCPA)

California residents may opt out of the sale of personal information.
